Indiana sets the BAC limit at 0.08 for DUI charges, with first-offense penalties including class c misdemeanor — up to 60 days jail, up to $500 fine, 90-day to 2-year license suspension. The state follows stand-your-ground law, meaning there is no duty to retreat before using force in self-defense. Indiana does offer expungement for eligible offenses — an important option for protecting future employment and immigration status. For non-citizen Arab Americans, federal crime defense convictions can trigger deportation proceedings. An Arabic-speaking defense attorney in Indiana evaluates both criminal penalties and immigration consequences before advising on pleas or trial strategy.

If you receive a target letter or learn you are under federal investigation, contact a federal defense attorney immediately. Pre-indictment intervention can sometimes prevent charges.
Federal cases require grand jury indictment. While grand juries almost always indict, your attorney can present exculpatory evidence and challenge the government's case before trial.
Review voluminous federal discovery — wiretaps, financial records, informant reports. File critical pre-trial motions to suppress evidence, challenge informant reliability, or argue entrapment.
Federal trial conviction rates exceed 90%. If the evidence is strong, a carefully negotiated plea with cooperation or safety valve provisions can achieve below-guidelines sentencing. If the case has real defenses, trial may be the best option.

Every state has different criminal laws and penalties. Here's what you need to know about defending charges in Indiana.
Class C misdemeanor — up to 60 days jail, up to $500 fine, 90-day to 2-year license suspension
Level 6 felony if prior within 7 years — 6 months to 2.5 years prison, up to $10,000 fine, minimum 1-year license suspension
Indiana calls DUI "Operating While Intoxicated" (OWI) under IC 9-30-5. A first OWI with a BAC of 0.15% or higher is a Class A misdemeanor (up to 1 year jail, $5,000 fine). OWI with a minor passenger under 18 is an enhanced offense. Indiana also has an "operating while intoxicated endangering a person" charge that applies when the driving is dangerous. Refusal to submit to a chemical test results in a 1-year license suspension.
Possession of any amount: Class B misdemeanor (up to 180 days jail, $1,000 fine). Prior conviction or amount over 30g: Class A misdemeanor or Level 6 felony. Hash oil and concentrates are always a felony regardless of amount.
Indiana has some of the strictest marijuana laws in the Midwest. Possession of hash oil or concentrates in any amount is a Level 6 felony (6 months to 2.5 years). Indiana has NOT legalized medical marijuana. Drug courts are available in many Indiana counties as alternatives to incarceration. For non-citizens, any marijuana conviction — even a small amount — can result in deportation or denial of naturalization under federal law.
Class B misdemeanor (battery) — up to 180 days jail, $1,000 fine. Class A misdemeanor if resulting in bodily injury — up to 1 year jail, $5,000 fine
Level 5 felony (1-6 years) for battery with deadly weapon or causing serious bodily injury. Level 3 felony (3-16 years) for aggravated battery causing serious permanent disfigurement or loss of a bodily function
Indiana has a strong castle doctrine and stand your ground law (IC 35-41-3-2). There is no duty to retreat before using force in self-defense anywhere you have a right to be. Deadly force is justified if you reasonably believe it is necessary to prevent serious bodily injury or death, or to prevent the commission of a forcible felony. The castle doctrine applies to dwellings, curtilage, and occupied vehicles.
Indiana has a comprehensive expungement statute (IC 35-38-9, called "Second Chance Law"). Most misdemeanors are eligible 5 years after conviction. Level 6 felonies (formerly Class D) are eligible 8 years after conviction. Some higher felonies are eligible 8-10 years after conviction. Violent felonies and sex offenses are generally not eligible. Filing fees range from $157 to $500.
Indiana uses a Level 1-6 felony system (Level 1 most serious, replacing the former Class A-D system in 2014). Level 6 felonies can sometimes be reduced to misdemeanors after successful completion of probation. Indiana also has a habitual offender enhancement that can add significant time for repeat felony offenders.
Indiana's criminal laws create significant immigration risks for non-citizens. OWI (DUI) convictions, even as misdemeanors, can affect immigration applications and naturalization. Marijuana possession — illegal at any amount — is a deportable offense under federal law. Hash oil possession is automatically a felony in Indiana, which can be an aggravated felony for immigration purposes. Indiana's stand your ground law provides self-defense protections, but a conviction for excessive force could trigger deportation. An Arabic-speaking attorney who understands both Indiana criminal law and federal immigration consequences is essential for any non-citizen facing charges.
For Arab and Muslim community members with immigration concerns, it is critical to have an attorney who understands both criminal defense strategy and immigration consequences. A conviction that seems minor can lead to deportation, denial of naturalization, or loss of visa status.
