Arizona has three DUI tiers: standard (0.08%+), extreme (0.15%+), and super extreme (0.20%+). Even first-offense DUI carries mandatory jail time — one of the strictest in the nation.
Legal for adults 21+ (up to 1 oz, 5g concentrate) under Prop 207 (2020). Prior marijuana convictions eligible for expungement.
Arizona legalized recreational marijuana in 2020 via Proposition 207. However, federal law still applies — marijuana possession remains a deportable offense for non-citizens.
Class 1 misdemeanor — up to 6 months jail, $2,500 fine
Class 2-6 felony depending on circumstances — up to 15 years prison (aggravated assault with deadly weapon)
Arizona has a strong stand your ground law with no duty to retreat. You may use deadly force if a reasonable person would believe it is immediately necessary to protect against another's use or attempted use of unlawful deadly physical force. Castle Doctrine also applies.
Arizona adopted "set aside" (expungement-like) relief in 2023. Eligible convictions can be set aside after completing the sentence, removing disabilities of conviction. A separate record sealing law also took effect in 2023.
