“Got charged with DWAI in Aurora — that's Colorado's lower DUI charge at 0.05%. I was on a green card and terrified about deportation. My attorney got the charge reduced and made sure there were no immigration consequences. He knew Colorado's unique DUI laws and explained everything in Arabic.”

“Got arrested for possession of pills that weren't mine — they were in a friend's car. I'm on a green card and a drug conviction means deportation. My attorney challenged the search and got the charges reduced to a petty offense. He spoke Arabic and understood what was at stake for my immigration status.”

Nizar K.

“A road rage incident on 6th Avenue led to the other driver calling police and accusing me of assault. I never left my car. My lawyer got dashcam footage from a nearby business that proved I did nothing wrong. Charges dropped before trial. He spoke Arabic and believed my story from day one.”

Every state has different criminal laws and penalties. Here's what you need to know about defending charges in Colorado.
Colorado has a unique DWAI (Driving While Ability Impaired) charge at 0.05% BAC, in addition to DUI at 0.08% and DUI per se. The DWAI is a lesser offense but still carries criminal penalties and immigration consequences. Colorado uses a lifetime lookback — all prior offenses count regardless of when they occurred.
Legal for adults 21+ (up to 2 oz). Colorado was one of the first two states to legalize recreational marijuana in 2012 (Amendment 64). Under 21 or over limits: petty offense to misdemeanor.
Colorado was a pioneer in marijuana legalization (2012, alongside Washington). However, marijuana remains illegal under federal law — any marijuana use, possession, or employment in the marijuana industry can result in deportation, denial of naturalization, or inadmissibility for non-citizens. Colorado has no mandatory minimums for most drug crimes.
Third degree assault — class 1 misdemeanor, up to 364 days jail, $1,000 fine
First degree assault — class 3 felony, 10-32 years prison. Second degree assault — class 4 felony, 2-8 years
Colorado has one of the strongest castle doctrine laws in the country — the "Make My Day" law (CRS 18-1-704.5). Homeowners may use deadly force against an intruder who has made an unlawful entry and the occupant reasonably believes the intruder might use physical force against any occupant. In public, Colorado requires a reasonable belief of imminent threat but does not have a statutory duty to retreat.
Colorado expanded record sealing significantly in 2022. Most criminal records are eligible for sealing after waiting periods: petty offenses immediately, misdemeanors after 2 years, many felonies after 3+ years. Drug offenses and some felonies have specific eligibility rules. Sealed records are not destroyed but are hidden from public view.
Colorado uses class 1-6 felonies (class 1 most serious) and class 1-3 misdemeanors. The state has no mandatory minimum sentences for most crimes. Colorado's 2022 record sealing expansion was one of the most progressive in the country.
