Colorado has a unique DWAI (Driving While Ability Impaired) charge at 0.05% BAC, in addition to DUI at 0.08% and DUI per se. The DWAI is a lesser offense but still carries criminal penalties and immigration consequences. Colorado uses a lifetime lookback — all prior offenses count regardless of when they occurred.
Legal for adults 21+ (up to 2 oz). Colorado was one of the first two states to legalize recreational marijuana in 2012 (Amendment 64). Under 21 or over limits: petty offense to misdemeanor.
Colorado was a pioneer in marijuana legalization (2012, alongside Washington). However, marijuana remains illegal under federal law — any marijuana use, possession, or employment in the marijuana industry can result in deportation, denial of naturalization, or inadmissibility for non-citizens. Colorado has no mandatory minimums for most drug crimes.
Third degree assault — class 1 misdemeanor, up to 364 days jail, $1,000 fine
First degree assault — class 3 felony, 10-32 years prison. Second degree assault — class 4 felony, 2-8 years
Colorado has one of the strongest castle doctrine laws in the country — the "Make My Day" law (CRS 18-1-704.5). Homeowners may use deadly force against an intruder who has made an unlawful entry and the occupant reasonably believes the intruder might use physical force against any occupant. In public, Colorado requires a reasonable belief of imminent threat but does not have a statutory duty to retreat.
Colorado expanded record sealing significantly in 2022. Most criminal records are eligible for sealing after waiting periods: petty offenses immediately, misdemeanors after 2 years, many felonies after 3+ years. Drug offenses and some felonies have specific eligibility rules. Sealed records are not destroyed but are hidden from public view.
