Every state has different criminal laws and penalties. Here's what you need to know about defending charges in Tennessee.
Tennessee has some of the strictest DUI penalties in the country, including mandatory 48-hour jail for a first offense with no exceptions. A second offense within 10 years carries mandatory 45 days in jail. DUI with a BAC of 0.20% or higher doubles the mandatory minimum. Tennessee also has a vehicular assault charge for DUI causing serious injury (Class D felony, 2-12 years).
Simple possession (0.5 oz or less): Class A misdemeanor, up to 11 months 29 days jail, $2,500 fine. Over 0.5 oz: felony charges. Tennessee allows limited medical CBD oil only (0.9% THC or less) for specific conditions.
Tennessee has not legalized marijuana in any form beyond very limited CBD oil. Possession of any amount of marijuana flower is a criminal offense. Drug courts are available in many Tennessee counties as alternatives to incarceration. For non-citizens, even a minor marijuana charge can result in deportation or denial of naturalization.

Tennessee has a strong stand your ground law. There is no duty to retreat before using force in self-defense if you are in a place you have a right to be and are not engaged in criminal activity. The castle doctrine applies to homes, vehicles, and businesses. Deadly force is justified if there is a reasonable belief of imminent death or serious bodily harm.
Tennessee allows expungement of eligible misdemeanors and certain non-violent felonies after completion of sentence and waiting periods. Eligible offenses must be specifically listed in the expungement statute. A $350 filing fee applies. Some offenses are never eligible, including DUI, domestic assault, and sex offenses.
Tennessee uses Class A-E felonies (A most serious) and Class A-C misdemeanors. The state has a "three strikes" law — habitual criminals with three or more felonies can face enhanced sentencing. Tennessee also has a "truth in sentencing" law requiring certain violent offenders to serve at least 85% of their sentence.
