Every state has different criminal laws and penalties. Here's what you need to know about defending charges in Indiana.
Indiana calls DUI "Operating While Intoxicated" (OWI) under IC 9-30-5. A first OWI with a BAC of 0.15% or higher is a Class A misdemeanor (up to 1 year jail, $5,000 fine). OWI with a minor passenger under 18 is an enhanced offense. Indiana also has an "operating while intoxicated endangering a person" charge that applies when the driving is dangerous. Refusal to submit to a chemical test results in a 1-year license suspension.
Possession of any amount: Class B misdemeanor (up to 180 days jail, $1,000 fine). Prior conviction or amount over 30g: Class A misdemeanor or Level 6 felony. Hash oil and concentrates are always a felony regardless of amount.
Indiana has some of the strictest marijuana laws in the Midwest. Possession of hash oil or concentrates in any amount is a Level 6 felony (6 months to 2.5 years). Indiana has NOT legalized medical marijuana. Drug courts are available in many Indiana counties as alternatives to incarceration. For non-citizens, any marijuana conviction — even a small amount — can result in deportation or denial of naturalization under federal law.

Level 5 felony (1-6 years) for battery with deadly weapon or causing serious bodily injury. Level 3 felony (3-16 years) for aggravated battery causing serious permanent disfigurement or loss of a bodily function
Indiana has a strong castle doctrine and stand your ground law (IC 35-41-3-2). There is no duty to retreat before using force in self-defense anywhere you have a right to be. Deadly force is justified if you reasonably believe it is necessary to prevent serious bodily injury or death, or to prevent the commission of a forcible felony. The castle doctrine applies to dwellings, curtilage, and occupied vehicles.
Indiana has a comprehensive expungement statute (IC 35-38-9, called "Second Chance Law"). Most misdemeanors are eligible 5 years after conviction. Level 6 felonies (formerly Class D) are eligible 8 years after conviction. Some higher felonies are eligible 8-10 years after conviction. Violent felonies and sex offenses are generally not eligible. Filing fees range from $157 to $500.
Indiana uses a Level 1-6 felony system (Level 1 most serious, replacing the former Class A-D system in 2014). Level 6 felonies can sometimes be reduced to misdemeanors after successful completion of probation. Indiana also has a habitual offender enhancement that can add significant time for repeat felony offenders.
