Maryland distinguishes between DUI (0.08%+) and DWI (0.07%). DUI carries harsher penalties. Refusal to test results in 270-day license suspension.
Legal for adults 21+ (up to 1.5 oz usable, 12g concentrate). Previous convictions for amounts now legal are eligible for expungement.
Maryland legalized recreational marijuana in 2023. Drug courts are available in most jurisdictions across the state.
Misdemeanor (second degree assault) — up to 10 years jail, $2,500 fine
Felony (first degree assault) — up to 25 years prison
Maryland requires a duty to retreat before using deadly force. You must retreat if you can do so safely, except in your home (Castle Doctrine). Deadly force is only justified to prevent imminent death or serious bodily harm.
Maryland expanded expungement eligibility significantly. Most misdemeanors are eligible 3 years after completion of sentence. Some nonviolent felonies eligible 10 years after. Cannabis-related offenses eligible for immediate expungement.
Maryland does not use the felony/misdemeanor distinction in the traditional sense — offenses are classified by maximum penalty rather than label.
