Maryland is an equitable distribution state. The court divides marital property fairly based on monetary and non-monetary contributions, the circumstances leading to divorce, and each spouse's economic situation. Maryland courts can only divide marital property — they cannot transfer title of separately owned property.
Maryland's approach is unique: the court can grant a monetary award to achieve equity but generally cannot directly transfer one spouse's separately titled property to the other.
