Every state has different criminal laws and penalties. Here's what you need to know about defending charges in North Carolina.
North Carolina calls it DWI (Driving While Impaired), not DUI. The state uses a Level 1-5 punishment system based on aggravating and mitigating factors. Level 1 is the most severe (up to 24 months). Aggravating factors include BAC of 0.15%+ and prior convictions.
Up to 0.5 oz is a Class 3 misdemeanor (up to $200 fine, no jail for first offense). Over 0.5 oz is a Class 1 misdemeanor (up to 120 days). Over 1.5 oz is a felony.
North Carolina is one of the last states where marijuana is fully illegal — no medical or recreational use. Drug trafficking carries mandatory minimums. For non-citizens, any marijuana conviction, even a small amount, can trigger deportation.
Class 2 misdemeanor — up to 60 days jail, fine at discretion of court
Assault with deadly weapon with intent to kill — Class C felony (44-98 months). Assault inflicting serious bodily injury — Class F felony (10-41 months)
North Carolina has both stand your ground and castle doctrine laws. You have no duty to retreat before using force in self-defense anywhere you have a lawful right to be. Deadly force is justified to prevent imminent death or great bodily harm.
North Carolina allows expungement of dismissed charges, not guilty verdicts, and certain first-time misdemeanor and nonviolent felony convictions. Waiting periods range from 5 to 15 years depending on the offense. Drug offenses and some violent crimes are not eligible.
North Carolina uses a structured sentencing grid based on offense class (A-I for felonies, 1-3 for misdemeanors) and prior record level (I-VI). The grid determines minimum and maximum sentence ranges. Judges have limited discretion outside the grid.
