Indiana uses the term OWI (Operating While Intoxicated) rather than DUI, and the Marion County courts handle a high volume of OWI cases. Marion Superior Court Criminal Division processes felonies while township courts handle misdemeanors. Arab community members—particularly Iraqi refugees on the south and northwest sides—face immigration consequences from any criminal conviction, even misdemeanors. An Arabic-speaking defense attorney who understands both Indiana criminal law and federal immigration consequences can protect clients' legal status while defending against charges.
Our Arabic-speaking dui/dwi attorneys guide you through every step of your case in Indianapolis.
Within hours of arrest, contact an Arabic-speaking DUI attorney. We guide you through bail, vehicle impound, and the critical first steps to protect your license and immigration status.
Request a DMV hearing to challenge automatic license suspension. This is separate from criminal court and has strict deadlines — often just 10 days from arrest.
Review all evidence including breathalyzer calibration records, field sobriety test procedures, dashcam footage, and the legality of the traffic stop itself.
Negotiate with prosecutors for reduced charges (wet reckless, reckless driving) or dismissal. If necessary, prepare a strong trial defense.

“Got arrested for possession after a traffic stop on East Washington Street. I'm 24 and on a student visa at IUPUI. My attorney got me into pretrial diversion — completed the program and charges were dismissed. No record, no deportation risk. He spoke Arabic and understood what was at stake.”

“Got charged with OWI in Fort Wayne after a family gathering. I'm on a green card and was terrified about deportation. My lawyer got the charge reduced — no OWI on my record and no immigration consequences. He knew both Indiana criminal law and immigration law. Saved my family from losing everything we built here.”

“Got into a workplace altercation when a coworker shoved me and I pushed back. Police arrested us both. My lawyer showed the factory's security footage proving I acted in self-defense. Charges reduced to disorderly conduct with no jail time. He spoke Arabic and made sure my green card wasn't affected.”

Every state has different criminal laws and penalties. Here's what you need to know about defending charges in Indiana.
Indiana calls DUI "Operating While Intoxicated" (OWI) under IC 9-30-5. A first OWI with a BAC of 0.15% or higher is a Class A misdemeanor (up to 1 year jail, $5,000 fine). OWI with a minor passenger under 18 is an enhanced offense. Indiana also has an "operating while intoxicated endangering a person" charge that applies when the driving is dangerous. Refusal to submit to a chemical test results in a 1-year license suspension.
Possession of any amount: Class B misdemeanor (up to 180 days jail, $1,000 fine). Prior conviction or amount over 30g: Class A misdemeanor or Level 6 felony. Hash oil and concentrates are always a felony regardless of amount.
Indiana has some of the strictest marijuana laws in the Midwest. Possession of hash oil or concentrates in any amount is a Level 6 felony (6 months to 2.5 years). Indiana has NOT legalized medical marijuana. Drug courts are available in many Indiana counties as alternatives to incarceration. For non-citizens, any marijuana conviction — even a small amount — can result in deportation or denial of naturalization under federal law.
Class B misdemeanor (battery) — up to 180 days jail, $1,000 fine. Class A misdemeanor if resulting in bodily injury — up to 1 year jail, $5,000 fine
Level 5 felony (1-6 years) for battery with deadly weapon or causing serious bodily injury. Level 3 felony (3-16 years) for aggravated battery causing serious permanent disfigurement or loss of a bodily function
Indiana has a strong castle doctrine and stand your ground law (IC 35-41-3-2). There is no duty to retreat before using force in self-defense anywhere you have a right to be. Deadly force is justified if you reasonably believe it is necessary to prevent serious bodily injury or death, or to prevent the commission of a forcible felony. The castle doctrine applies to dwellings, curtilage, and occupied vehicles.
Indiana has a comprehensive expungement statute (IC 35-38-9, called "Second Chance Law"). Most misdemeanors are eligible 5 years after conviction. Level 6 felonies (formerly Class D) are eligible 8 years after conviction. Some higher felonies are eligible 8-10 years after conviction. Violent felonies and sex offenses are generally not eligible. Filing fees range from $157 to $500.
Indiana uses a Level 1-6 felony system (Level 1 most serious, replacing the former Class A-D system in 2014). Level 6 felonies can sometimes be reduced to misdemeanors after successful completion of probation. Indiana also has a habitual offender enhancement that can add significant time for repeat felony offenders.
