Maryland requires a 12-month separation period for no-fault divorce, though fault-based grounds like adultery or cruelty allow immediate filing. Baltimore City Circuit Court Family Division handles divorce, custody, and support matters. Maryland follows equitable distribution for marital property. Courts apply a "best interest of the child" standard for custody using factors including parental fitness, stability, and the child's preference if mature enough. Mahr agreements are generally enforceable as prenuptial contracts if they meet Maryland contract formation requirements. Arab families often need authentication of foreign marriage certificates from Egyptian, Moroccan, or Palestinian consulates.
Our Arabic-speaking dv protection attorneys guide you through every step of your case in Baltimore.
We assess your immediate safety and develop a plan. This includes identifying safe housing, securing important documents, and protecting your immigration status. Everything is confidential.
We file for an emergency protective order that can be granted the same day without the abuser being present (ex parte). This provides immediate legal protection while longer-term solutions are put in place.
Within 2-3 weeks, a hearing is held where you present evidence and the abuser can respond. We prepare you thoroughly and present a compelling case for permanent protection.
If your immigration status is connected to the abuser, we file VAWA self-petitions or U-visa applications to secure independent immigration status. The abuser is not notified.

Testimonials

“I lost my job at a warehouse and couldn't keep up with child support payments. My ex wanted me held in contempt. My lawyer filed for modification in Baltimore City court and got a fair recalculation based on my actual income. He spoke Arabic and treated me with dignity when I felt at my lowest.”

Amr S.
Baltimore, Maryland
2025
“My divorce involved a mahr agreement and property in Lebanon. Maryland law is complicated — the court can't just transfer property, they use monetary awards. My lawyer understood both the Islamic contract and Maryland's system and got me a fair settlement. I could discuss everything in Arabic.”

Layla M.
Rockville, Maryland
2025
“My ex tried to get full custody in Montgomery County by claiming I wasn't a fit mother. My lawyer gathered character witnesses from our community and got the judge to enforce my mahr as a separate contract. I won primary custody and my children are stable. She understood Iraqi family dynamics and spoke Arabic through everything.”

Zahra D.
Silver Spring, Maryland

Understanding Maryland's family law statutes helps you protect your rights and plan your case. Here's what you need to know.
Adultery, Desertion (12+ months), Conviction of a felony or misdemeanor with 3+ years sentence, Cruelty, Insanity (3+ years)
Maryland eliminated the 12-month separation requirement in 2023, replacing it with mutual consent divorce (no waiting period) and a 6-month separation option.
Maryland is an equitable distribution state. The court divides marital property fairly based on monetary and non-monetary contributions, the circumstances leading to divorce, and each spouse's economic situation. Maryland courts can only divide marital property — they cannot transfer title of separately owned property.
Maryland's approach is unique: the court can grant a monetary award to achieve equity but generally cannot directly transfer one spouse's separately titled property to the other.
Best interests of the child
No
Maryland does not have a statutory presumption for joint custody, but courts regularly award joint legal custody when parents can cooperate.
Maryland uses the income shares model based on both parents' combined adjusted actual income. Guidelines apply to combined income up to $30,000/month.
Support may continue to 19 if the child is still in high school. Courts may also order support for college expenses.
